Feds Temporarily Block Trump's Crackdown on Foreign Students at Harvard

In a surprising turn, U.S. District Judge Allison D. Burroughs halted President Donald Trump's assault on foreign students planning to attend Harvard University on Thursday. The Ivy League institution had filed a legal challenge in response to the President's latest attack.

The judge granted a temporary restraining order, prohibiting anyone from implementing, instigating, maintaining, reinforcing, or enforcing the Presidential Proclamation that Trump issued Wednesday. Harvard earlier made changes to its complaint against the Trump administration to challenge the President's proclamation, which intended to deny visas to foreign students planning to study at Harvard, marking a new chapter in his ongoing attack on the prestigious university.

The amended complaint by Harvard argued that the immigration law underpinning Trump's proclamation allows the President to prohibit "a class of aliens whose entry would be 'detrimental to the interests of the United States.'" However, the complaint contends that Trump's proclamation does not suspend entry for a class, but only students who wish to attend Harvard. In essence, according to the university, Trump's actions go beyond protecting national interests and amount to a vendetta.

The attempts to target international students, as argued by Harvard, impacts all students because Harvard "prepares them to contribute to and lead in our global society." The President's actions, the complaint asserts, violate the First Amendment rights of Harvard University.

Trump's proclamation, if implemented, would not affect only incoming students. It also calls for reviewing existing foreign students at Harvard under F, M, or J visas, to determine if their visas should be revoked.

This latest move against Harvard follows an attempt by the Department of Homeland Security last month to curb Harvard's ability to enroll foreign students by revoking its certification in the Student and Exchange Visitor Program. However, the federal judge blocked this earlier attempt as well. Burroughs extended the restraining order until June 20, or until a preliminary injunction order can be issued.

Trump and his administration have a history of targeting Harvard, claiming that the university has not adequately addressed antisemitism on campus during demonstrations against the Israel-Hamas war. Harvard, in response to Federal pressure, had earlier rejected demands to audit the viewpoints of the student body. The Federal government had then reportedly threatened to freeze more than $2 billion in federal grants to the university.

Harvard President Alan M. Garber expressed solidarity with the international students in a letter to the campus community, vowing to defend their interests as they continue to assert their Constitutional rights.
